Welcome to GrammarX! These Terms and Conditions ("Terms") govern your access to and use of the GrammarX mobile application ("App"), including all content, features, competitions, rewards, and services provided through the App.

By downloading, installing, accessing, or using GrammarX, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Definitions

For the purposes of these Terms:

• "App" refers to the GrammarX mobile application
• "We," "Us," "Our" refers to GrammarX and its operators
• "User," "You," "Your" refers to any individual or entity accessing or using the App
• "Services" refers to all features, content, competitions, and functionalities provided through the App
• "Content" refers to all text, graphics, images, lessons, quizzes, questions, and other materials available on the App
• "User Account" refers to the personal account you create to access the App's features

2. Acceptance of Terms

By using GrammarX, you confirm that:

• You are at least 13 years of age, or have parental/guardian consent if under 13
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate, current, and complete

3. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal mobile device
• Access and use the App for personal, non-commercial purposes
• Access grammar lessons, practice quizzes, and participate in competitions

3.1 License Restrictions

You may NOT:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Remove, alter, or obscure any proprietary notices on the App
• Use the App for any commercial purposes without our written permission
• Create derivative works based on the App or its content

4. User Account

4.1 Account Creation

To access certain features of the App, including competitions and progress tracking, you must create a User Account by providing:

• Your name
• A valid email address
• A secure password

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

4.3 Account Termination

You may delete your account at any time through the App settings. Upon account deletion:

• Your personal data will be deleted in accordance with our Privacy Policy
• You will lose access to your learning progress, earned points, and rewards
• Any pending rewards or prizes may be forfeited

5. Acceptable Use Policy

When using GrammarX, you agree to:

• Use the App in accordance with these Terms and all applicable laws
• Provide accurate information when creating your account
• Respect the intellectual property rights of GrammarX and other users
• Participate in competitions fairly and honestly
• Treat other users with respect in any interactive features

6. Prohibited Conduct

• Cheating: Using automated tools, bots, scripts, or any unfair methods to gain advantages in quizzes or competitions
• Multiple Accounts: Creating multiple accounts to manipulate competitions, earn duplicate rewards, or circumvent restrictions
• Hacking: Attempting to gain unauthorized access to the App, other users' accounts, or our systems
• Content Theft: Copying, scraping, or redistributing our grammar lessons, questions, or other proprietary content
• Harassment: Engaging in abusive, threatening, or harassing behavior toward other users or our staff
• False Information: Providing false personal information or impersonating others
• Spam: Sending unsolicited messages, promotional content, or advertisements through the App
• Malicious Activity: Uploading viruses, malware, or any harmful code
• System Interference: Disrupting or interfering with the App's functionality or servers

7. Competitions and Rewards

7.1 Competition Participation

GrammarX offers weekly grammar competitions where users can compete for prizes and rewards. By participating, you agree that:

• You will compete fairly and honestly without using any cheating methods
• Competition rules, formats, and schedules may change at our discretion
• We reserve the right to verify winners and disqualify participants who violate these Terms
• Decisions regarding competition results and prize distribution are final

7.2 Rewards and Prizes

Rewards and prizes earned through competitions are subject to the following conditions:

• Prizes may include points, badges, certificates, gift cards, or other items as specified
• Rewards have no cash value unless explicitly stated
• We reserve the right to substitute prizes of equal or greater value
• Prize delivery timelines will be communicated to winners
• Unclaimed prizes may expire after a specified period
• Winners may be required to provide additional information for prize verification

7.3 Disqualification

We reserve the right to disqualify participants and revoke prizes if:

• Cheating or unfair practices are detected
• Multiple accounts are being used
• These Terms are violated in any way

8. Intellectual Property Rights

8.1 Our Content

All content provided through the App, including but not limited to:

• Grammar lessons and educational materials
• Quiz questions and answers
• Graphics, logos, icons, and images
• Software code and functionality
• Text, audio, and video content

...is owned by or licensed to GrammarX and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our explicit written permission.

8.2 Trademarks

The GrammarX name, logo, and all related marks are trademarks of GrammarX. You may not use these trademarks without our prior written consent.

9. User-Generated Content

If the App allows you to submit feedback, comments, or other content ("User Content"), you agree that:

• You retain ownership of your User Content
• You grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your User Content
• Your User Content does not violate any third-party rights or these Terms
• We may remove any User Content that violates these Terms at our discretion

10. Payment and Subscriptions

10.1 Free and Premium Features

GrammarX offers both free and premium features. Premium features may require:

• One-time purchases
• Subscription payments (monthly, yearly, etc.)

• Payments are processed through Google Play Store or Apple App Store
• Subscription renewals are automatic unless canceled before the renewal date
• Refunds are handled according to the respective app store's refund policy

11. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the practices described in our Privacy Policy.

12. Disclaimers and Warranties

12.1 "As Is" Basis

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of content

12.2 Educational Purposes

While we strive to provide accurate and helpful grammar education:

• The App is intended for educational purposes only
• We do not guarantee specific learning outcomes or exam success
• Content should not be relied upon as the sole source of grammar education

13. Limitation of Liability

To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim
• We are not responsible for any losses resulting from unauthorized account access, user errors, or third-party actions
• We are not liable for technical issues, data loss, or service interruptions

14. Indemnification

You agree to indemnify, defend, and hold harmless GrammarX, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any User Content you submit

15. Termination and Suspension

15.1 Our Right to Terminate

We reserve the right to suspend or terminate your account and access to the App at any time, without prior notice, if:

• You violate these Terms
• You engage in prohibited conduct
• We suspect fraudulent or illegal activity
• Required by law or legal process

15.2 Effects of Termination

Upon termination:

• Your right to use the App immediately ceases
• You must delete the App from your device
• Any pending rewards or prizes may be forfeited
• Sections of these Terms that should survive termination will remain in effect

16. Modifications to the App and Terms

16.1 App Updates

We may update, modify, or discontinue any feature of the App at any time without prior notice. We are not liable for any modifications or discontinuation of services.

16.2 Changes to Terms

We reserve the right to modify these Terms at any time. When changes are made:

• The "Last Updated" date will be revised
• Material changes will be communicated through the App or via email
• Continued use of the App after changes constitutes acceptance of the new Terms
• If you disagree with the changes, you must stop using the App

17. Governing Law and Dispute Resolution

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

17.2 Dispute Resolution

In the event of any dispute arising from these Terms or your use of the App:

• You agree to first attempt to resolve the dispute informally by contacting us
• If informal resolution fails, disputes shall be resolved through binding arbitration or the courts of West Bengal, India

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GrammarX regarding the use of the App and supersede all prior agreements and understandings.

20. Third-Party Services

The App may contain links to third-party websites, services, or resources. We are not responsible for:

• The availability or accuracy of such third-party services
• The content, products, or services available through third-party links
• Any harm or damages arising from your use of third-party services

21. Children's Use

The App is designed for users of all ages, including children. If you are under 13 years of age:

• You must have your parent's or guardian's permission to use the App
• Your parent or guardian must agree to these Terms on your behalf
• We encourage parents to monitor their children's use of the App
